Bu \u00e7al\u0131\u015fmada ise meslek hastal\u0131klar\u0131na yer verilecektir.<\/p><h3><strong>Meslek Hastal\u0131\u011f\u0131 Nedir?<\/strong><\/h3><p>\u00a0<\/p><p>Meslek hastal\u0131klar\u0131 5510 Say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu ve 6331 Say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nda ayr\u0131 ayr\u0131 tan\u0131mlanm\u0131\u015ft\u0131r;<\/p><p>5510 Say\u0131l\u0131 Kanun kapsam\u0131nda meslek hastal\u0131\u011f\u0131; sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011finden dolay\u0131 tekrarlanan bir sebeple veya i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 y\u00fcz\u00fcnden u\u011frad\u0131\u011f\u0131 ge\u00e7ici veya s\u00fcrekli hastal\u0131k, bedensel veya ruhsal \u00f6z\u00fcrl\u00fcl\u00fck halleridir.<\/p><p>6331 Say\u0131l\u0131 Kanun kapsam\u0131nda meslek hastal\u0131\u011f\u0131; mesleki risklere maruziyet sonucunda ortaya \u00e7\u0131kan hastal\u0131kt\u0131r. Bu a\u00e7\u0131klamadan da anla\u015f\u0131laca\u011f\u0131 \u00fczere meslek hastal\u0131\u011f\u0131ndan bahsedilebilmesi i\u00e7in i\u015f ile ilgili fakt\u00f6rlerden dolay\u0131 ortaya \u00e7\u0131kan bir hastal\u0131k olmas\u0131 gerekmektedir.<\/p><h3><strong>Meslek Hastal\u0131\u011f\u0131 \u0130le \u0130lgili Kavramlar Nelerdir?<\/strong><\/h3><p>\u00a0<\/p><p><strong>Y\u00fck\u00fcml\u00fcl\u00fck S\u00fcresi<\/strong>: Meslek hastal\u0131\u011f\u0131n\u0131 olu\u015fturacak zararl\u0131 mesleksel etkinin sona ermesinden itibaren hastal\u0131\u011f\u0131n ortaya \u00e7\u0131kmas\u0131 aras\u0131nda ge\u00e7en en uzun s\u00fcreyi ifade eder.<\/p><p><strong>Maruziyet S\u00fcresi<\/strong>: Meslek hastal\u0131\u011f\u0131n\u0131 olu\u015fturacak zararl\u0131 mesleki etkinin ba\u015flamas\u0131 ile hastal\u0131k belirtilerinin ortaya \u00e7\u0131kmas\u0131 aras\u0131nda ge\u00e7en s\u00fcredir. Bu kavram hastan\u0131n ne kadar s\u00fcre ile hastal\u0131k unsuruna maruz kald\u0131\u011f\u0131n\u0131 a\u00e7\u0131klamak i\u00e7in kullan\u0131l\u0131r.<\/p><h3><strong>Meslek Hastal\u0131\u011f\u0131 T\u00fcrleri Nelerdir?<\/strong><\/h3><p>\u00a0<\/p><p>\u0130\u015fyerinde etkene do\u011frudan maruz kalan ki\u015filerde g\u00f6r\u00fcnen meslek hastal\u0131klar\u0131 farkl\u0131 gruplara ayr\u0131lmaktad\u0131r. Meslek hastal\u0131klar\u0131 belirli mesleklere \u00f6zg\u00fc hastal\u0131klard\u0131r. Belirli bir illiyet ba\u011f\u0131n\u0131n bulunmas\u0131 sonucunda ortaya \u00e7\u0131kan meslek hastal\u0131klar\u0131, 1972 tarih ve 14223 say\u0131l\u0131 Resmi Gazete \u2019de yay\u0131nlanan Sosyal Sigortalar Kurumu Sosyal Sigorta Sa\u011fl\u0131k \u0130\u015flemleri T\u00fcz\u00fc\u011f\u00fc\u2019nde, hangi hastal\u0131k t\u00fcrlerinde oldu\u011fu belirtilmi\u015ftir.<\/p><p>\u0130lgili T\u00fcz\u00fc\u011f\u00fcn 5. Maddesi uyar\u0131nca; \u2018\u0130\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131 sonucu husule gelen ar\u0131zalar\u0131n sigortal\u0131n\u0131n mesle\u011finde kazanma g\u00fcc\u00fcn\u00fc ne oranda azaltaca\u011f\u0131, T\u00fcz\u00fc\u011fe ekli A, B, C, D, ve E cetvellerine g\u00f6re tespit edilir.\u2019 \u0130fadesi yer almaktad\u0131r. Bu maddeden de anla\u015f\u0131laca\u011f\u0131 \u00fczere meslek hastal\u0131klar\u0131 5 farkl\u0131 gruba ayr\u0131l\u0131r (A, B, C, D, E,).<\/p><p><strong>A Grubu<\/strong>: Kimyasal Maddelerle Olan Meslek Hastal\u0131klar\u0131; Bir k\u0131sm\u0131 zehirlenmelere, bir k\u0131sm\u0131 da kanser t\u00fcrlerine yol a\u00e7an, kur\u015fun, c\u0131va, kadminyum, benzen, hekzan gibi kimyasallar\u0131n yol a\u00e7t\u0131\u011f\u0131 hastal\u0131klar\u0131 i\u00e7inde bar\u0131nd\u0131ran gruptur. Her maddenin v\u00fccutta yol a\u00e7t\u0131\u011f\u0131 hasar farkl\u0131 olabilmektedir. Bu kimyasallar v\u00fccuda kat\u0131, s\u0131v\u0131 veya gaz halinde sindirim, solunum veya deri yoluyla girerler. Bu hastal\u0131klar A grubu i\u00e7inde 25 alt grupta 67 hastal\u0131k t\u00fcr\u00fcnde bulunmaktad\u0131r.<\/p><p><strong>B Grubu<\/strong>: Mesleki Deri Hastal\u0131klar\u0131: Bir k\u0131sm\u0131 kansere, bir k\u0131sm\u0131 da kanserle\u015fmeyen deri hastal\u0131klar\u0131na neden olan maddelerin cilde temas\u0131 sonucunda ortaya \u00e7\u0131kan hastal\u0131klar\u0131 i\u00e7inde bar\u0131nd\u0131ran gruptur. Meslek hastal\u0131klar\u0131n\u0131n yakla\u015f\u0131k %30 deri hastal\u0131klar\u0131d\u0131r. Bu hastal\u0131klar\u0131n da %90\u2019\u0131 Kontrakt Dermotitlerdir (deri iltihab\u0131). Deri hastal\u0131klar\u0131 en \u00e7ok el b\u00f6lgesinde g\u00f6z\u00fckmektedir. Bu hastal\u0131k grubunda i\u015fveren taraf\u0131ndan y\u00fck\u00fcml\u00fcl\u00fck s\u00fcresi; kanserler i\u00e7in 5, kanserle\u015fmeyen deri hastal\u0131klar\u0131 i\u00e7in ise 2 y\u0131ld\u0131r.<\/p><p><strong>C Grubu<\/strong>: Pn\u00f6mokonyozlar ve Di\u011fer Mesleki Solunum Sistemi Hastal\u0131klar\u0131: Pn\u00f6mokonyoz; akci\u011ferlerde toz birikmesi sonucu doku hasar\u0131 olu\u015fturan meslek hastal\u0131\u011f\u0131d\u0131r. Solunum yolu ile maruziyet sonucu olu\u015fan bu grup hastal\u0131klar havadaki kirleticilerin solunum yolu ile v\u00fccuda giri\u015fi sonucunda olu\u015fur. Bu kirleticilerin ba\u015f\u0131nda ise toz gelmektedir. \u0130nsan sa\u011fl\u0131\u011f\u0131 i\u00e7in \u00f6nem arz eden 0.5-100 mikron aras\u0131ndaki b\u00fcy\u00fckl\u00fcklere sahip tozlar mesleki akci\u011fer hastal\u0131klar\u0131n\u0131n olu\u015fmas\u0131nda en \u00f6nemli unsurdur. Bu grup alt\u0131nda 6 alt grupta 9 hastal\u0131k bulunmaktad\u0131r.<\/p><p><strong>D Grubu<\/strong>: Mesleki Bula\u015f\u0131c\u0131 Meslek Hastal\u0131klar\u0131: Belirli \u00fcr\u00fcnlerin maruziyeti sonucunda, genellikle vir\u00fcs, bakteri ve parazitlerden, solunum, deri ve sindirim yollar\u0131yla bula\u015fan hastal\u0131k t\u00fcrlerini i\u00e7inde bar\u0131nd\u0131ran gruptur. \u00d6rne\u011fin; \u015farbon hastal\u0131\u011f\u0131, bakterilerin bula\u015fmas\u0131 sonucu olu\u015fur ve bu hastal\u0131k genellikle \u00e7ift\u00e7i, kasap ve veteriner gibi hayvanlarla temas\u0131 bulunan meslek gruplar\u0131nda g\u00f6r\u00fcl\u00fcr. Bu hastal\u0131k grubu 4 alt grup ve 30 hastal\u0131k t\u00fcr\u00fc olarak bulunmaktad\u0131r.<\/p><p><strong>E Grubu<\/strong>: Fiziksel Etkenlerle Olu\u015fan Meslek Hastal\u0131klar\u0131: \u00c7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131na zarar veren zararl\u0131 etmenleri i\u00e7inde bulunduran gruptur. Fiziksel etmenler, \u00e7al\u0131\u015fanlara rahat \u00e7al\u0131\u015fma olana\u011f\u0131 tan\u0131mad\u0131\u011f\u0131 gibi baz\u0131 meslek hastal\u0131klar\u0131na da neden olmaktad\u0131r. Fiziksel \u00e7evre fakt\u00f6rlerinin (titre\u015fim, g\u00fcr\u00fclt\u00fc, bas\u0131n\u00e7 vb.) verdi\u011fi zararlar ve yol a\u00e7t\u0131\u011f\u0131 meslek hastal\u0131klar\u0131 bu grup alt\u0131nda 7 alt grupta 12 hastal\u0131k t\u00fcr\u00fc olarak bulunmaktad\u0131r.<\/p><h3><strong>Meslek Hastal\u0131klar\u0131 Bildirimleri Nas\u0131l Yap\u0131l\u0131r?<\/strong><\/h3><p>\u00a0<\/p><p>T\u00fcrkiye\u2019de meslek hastal\u0131klar\u0131nda i\u015fverenler, \u00f6n tan\u0131 i\u015flemi gerekli kurumlarca yap\u0131ld\u0131ktan sonra 6331 Say\u0131l\u0131 Kanuna g\u00f6re; Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan yetkilendirilmi\u015f sa\u011fl\u0131k hizmeti sunucular\u0131na, <strong>\u00fc\u00e7 i\u015f g\u00fcn\u00fc <\/strong>i\u00e7erisinde sevk etmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p><p>T\u00fcrkiye\u2019de \u0130stanbul, Zonguldak ve Ankara\u2019da olmak \u00fczere \u00fc\u00e7 adet mesleki hastal\u0131k hastanesi bulunmaktad\u0131r. \u0130\u015fverence sevki yap\u0131lan personele meslek hastal\u0131\u011f\u0131 tan\u0131s\u0131n\u0131 bu 3 ilde bulunan hastaneler, devlet \u00fcniversiteleri t\u0131p fak\u00fclteleri ve devlet e\u011fitim ve ara\u015ft\u0131rma hastaneleri koyabilmektedir. A\u011fustos 2008 tarihine kadar sadece meslek hastal\u0131klar\u0131 hastaneleri meslek hastal\u0131klar\u0131 te\u015fhisi koyabiliyorken, bu tarihte meslek hastal\u0131\u011f\u0131 tan\u0131s\u0131 koyma yetkisi \u00fcniversite hastanelerine de verilmi\u015ftir.<\/p><p>Kesin tan\u0131 i\u015flemi koyulduktan sonra, te\u015fhis koyma yetkisi verilen ve te\u015fhisi koyan kurumlar, en ge\u00e7 on i\u015fg\u00fcn\u00fc i\u00e7erisinde Sosyal G\u00fcvenlik Kurumu\u2019na bildirmek zorundad\u0131r.<\/p><p>SGK Sa\u011fl\u0131k Kurulu, gelen mesleki hastal\u0131k te\u015fhisinin mesleki olup olmad\u0131\u011f\u0131, \u00e7al\u0131\u015fma veya meslekte kazanma g\u00fcc\u00fc oran\u0131n olup olmad\u0131\u011f\u0131 gibi kararlar\u0131 vermektedir. Verilen bu kararlara Sosyal Sigorta Y\u00fcksek Sa\u011fl\u0131k Kurulu nezdinde itiraz edebilir. Ayr\u0131ca \u00e7al\u0131\u015fan, gerekli durumlarda SGK \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc veya Sosyal G\u00fcvenlik Merkezlerine meslekte kazanma g\u00fcc\u00fcn\u00fcn tespit edilmesi i\u00e7in ba\u015fvuruda bulunabilir.<\/p><p>Meslek hastal\u0131\u011f\u0131n\u0131n SGK Sa\u011fl\u0131k Kurulunca tescil edilmesinden sonra, SGK \u00fcnitelerince i\u015fverene \u0130\u015f Kazas\u0131 ve Meslek Hastal\u0131\u011f\u0131 Bildirim Formu ile meslek hastal\u0131\u011f\u0131nda bulunmas\u0131 yaz\u0131l\u0131 olarak talep edilir. \u0130\u015fveren taraf\u0131ndan, bu tebligat\u0131n tebli\u011f edildi\u011fi tarih Kanunda yer alan <strong>\u2018\u00f6\u011frenildi\u011fi g\u00fcn\u2019 <\/strong>olarak kabul edilecek ve \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u00e7erisinde SGK\u2019ya bildirim yap\u0131lmas\u0131 gerekecektir.<\/p><h3><strong>\u0130\u015f\u00e7i-\u0130\u015fveren Sorumlulu\u011fu Nedir?<\/strong><\/h3><p>\u00a0<\/p><p><strong>\u0130\u015f\u00e7i Sorumlulu\u011fu<\/strong><\/p><p>\u0130\u015f\u00e7i, i\u015fveren taraf\u0131ndan belirlenen talimatlara uymak zorundad\u0131r. Ayr\u0131ca verilen i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimlerini hem kendi, hem birlikte \u00e7al\u0131\u015ft\u0131\u011f\u0131 \u00e7al\u0131\u015fma arkada\u015flar\u0131, hem de i\u015fvereni g\u00f6z \u00f6n\u00fcnde olarak uygulamal\u0131d\u0131r. \u0130\u00e7inde bulundu\u011fu risk grubunu \u00f6nemseyerek gerekli talimatlar\u0131 yerine getirmelidir. \u00d6rne\u011fin; deri hastal\u0131\u011f\u0131 ya da toza maruziyet s\u00f6z konusu ise; \u00e7al\u0131\u015fan ki\u015fisel koruyu donan\u0131m kullanmaya \u00f6zen g\u00f6stermeli, hatta ihmal etmemelidir. Ayr\u0131ca i\u015fverenin fark edemedi\u011fi tehlikeler kar\u015f\u0131s\u0131nda i\u015fvereni uyarmal\u0131 ve gerekli \u00f6nlemlerin al\u0131nmas\u0131n\u0131 sa\u011flamal\u0131d\u0131r. Mevzuat gere\u011fince personel, i\u015fveren taraf\u0131ndan gerekli \u00f6nlemlerin al\u0131nmas\u0131 gerekmesine ra\u011fmen al\u0131nmam\u0131\u015f ise, al\u0131nmas\u0131 i\u00e7in i\u015fvereni uyarmas\u0131na ra\u011fmen gerekli \u00f6nlem yine de al\u0131nmaz ise; personel i\u015fi yapmayabilir, hatta hakl\u0131 neden olarak fesih yapabilir.<\/p><p><strong>\u0130\u015fveren Sorumlulu\u011fu<\/strong><\/p><p>\u0130\u015fveren, i\u015fyerinin tehlike grubuna g\u00f6re \u0130\u015f Sa\u011fl\u0131\u011f\u0131 G\u00fcvenli\u011fi ve\/veya \u0130\u015fyeri Hekimi bulundurmak zorundad\u0131r. Bu tehlike s\u0131n\u0131flar\u0131 ve uzman\u0131n bu tehlike s\u0131n\u0131flar\u0131nda \u00e7al\u0131\u015fabilmesi i\u00e7in bulundurmas\u0131 gereken \u00f6zellikler \u015f\u00f6yledir:<\/p><ul><li>\u00c7ok Tehlikeli \u0130\u015fyeri S\u0131n\u0131f\u0131 (\u0130SG uzman\u0131 A S\u0131n\u0131f\u0131 uzmanl\u0131k belgesine sahip olmal\u0131d\u0131r.)<\/li><li>Tehlikeli \u0130\u015fyeri S\u0131n\u0131f\u0131 (\u0130SG uzman\u0131 B S\u0131n\u0131f\u0131 uzmanl\u0131k belgesine sahip olmal\u0131d\u0131r.)<\/li><li>Az Tehlikeli \u0130\u015fyeri S\u0131n\u0131f\u0131 (\u0130SG uzman\u0131 C S\u0131n\u0131f\u0131 uzmanl\u0131k belgesine sahip olmal\u0131d\u0131r.)<\/li><\/ul><p>\u00a0<\/p><p>B\u00fct\u00fcn bunlar\u0131n d\u0131\u015f\u0131nda i\u015fveren, gerekli \u00f6nlemleri de almal\u0131d\u0131r. Personeline \u0130SG uzman\u0131 vas\u0131tas\u0131yla e\u011fitimler vererek bilin\u00e7lendirmelidir. Koruyucu \u00f6nlemlerin al\u0131nmas\u0131n\u0131 sa\u011flamal\u0131d\u0131r. \u0130SG uzman\u0131n\u0131n gerekli g\u00f6rd\u00fc\u011f\u00fc \u00f6nlemleri almal\u0131d\u0131r.<\/p><p>\u0130\u015fveren gerekli t\u00fcm \u00f6nlemleri almas\u0131na, gerekli t\u00fcm kriterleri sa\u011flamas\u0131na ra\u011fmen personel \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi tedbirlerine uymadan hareket ediyorsa, i\u015fveren i\u015fi personele yapt\u0131rmayabilir, hatta hakl\u0131 neden olarak fesih yapabilir.<\/p><p>T\u00fcm bunlar\u0131n d\u0131\u015f\u0131nda Meslek Hastal\u0131klar\u0131n\u0131n maddi y\u00fck\u00fcml\u00fcl\u00fckleri; daha \u00f6nceki \u00e7al\u0131\u015fmalarda \u2018\u00c7ALI\u015eMA HAYATINDA \u0130\u015e KAZALARI\u2019 ba\u015fl\u0131\u011f\u0131 alt\u0131nda i\u015f kazalar\u0131 i\u00e7in ayr\u0131nt\u0131l\u0131 olarak bahsedildi\u011fi gibidir.<\/p><p><strong>T\u00fcrkiye\u2019de Meslek Hastal\u0131klar\u0131 \u0130statistikleri<\/strong><\/p><p>T\u00fcrkiye\u2019de meslek hastal\u0131klar\u0131 verileri SGK taraf\u0131ndan yay\u0131nlanmaktad\u0131r. SGK resmi sitesinde en son 2018 verileri yay\u0131nlanm\u0131\u015ft\u0131r.<\/p><p>2018 y\u0131l\u0131 SGK meslek hastal\u0131klar\u0131 verilerine g\u00f6re \u00fc\u00e7 ki\u015fi meslek hastal\u0131\u011f\u0131na yakalanm\u0131\u015ft\u0131r. Bunlardan birisi \u2018di\u011fer metalik olmayan \u00fcr\u00fcnlerin imalat\u0131\u2019 sekt\u00f6r\u00fc olarak kaydedilmi\u015ftir. Bir di\u011ferinin ise \u2018mobilya imalat\u0131\u2019 sekt\u00f6r\u00fcnde olarak kay\u0131tlara girmi\u015ftir. Son bir ki\u015fi ise \u2018bilinmeyen\u2019 k\u0131sm\u0131nda yer alm\u0131\u015ft\u0131r. Ayr\u0131ca bilinmeyen k\u0131sm\u0131nda yer alan ki\u015finin de \u00e7al\u0131\u015fmas\u0131 sona erdikten sonra meslek hastal\u0131\u011f\u0131 ortaya \u00e7\u0131km\u0131\u015ft\u0131r.
